A Misconception.

Mr. Lo, in reply, said that all the cases quoted by Mr. D'Almada went to show that the words of the Ordinance had to be considered in their natural meaning. One thing was clear; it applied to two alter natives, both of which were avail- able at the present time, Mr. D'Almada argued that where the of- fence against the Ordinance was also an offence against another Or dinance for which the defendant was acquitted or convicted then no proceedings could be taken.

Continuing, Mr. Lo submitted that the Section was a saving Sec- tion to prevent an argument like that being raised. Mr. Lo then went on to give examples and quotations, and said that it had nothing to do with autrefois acquit. It was not meant to be applied to the present case.

Mr. Lo said that any other argue ment must do violence to the language which allowed him to have alternatives. The whole point was if the defendant were guilty of an offence under the Ordinance or under the Corrupt Practice or un der any other Ordinance then he (Mr. Lo) was entitled to for him either under one or the go other.
