The alleged purchase, on the instalment system, of a Fiat two- seater car, of its assignment as security for a loan of $1,000 before full payment had been made, and of its subsequent sale by the purchaser to a third party formed the features of a claim before the Puisne, Jedge (Mr. Justice Jacks) in the Summary Court this morn- ing.
The claim was by Mahan Shagh. against B. R. Iranet for $1,040, of which $40 was waived.
Mr. J. M. d'Almada Remedios was for the plaintiff and Mr. F. C. Rendall for the defenant.
At the outset, Mr. Remedios said the action turned on a bill of sale. although the defence was that the action was premature and that the goods mentioned in the bill were not specifically stated.
Mr. Rendall explained that the only indication they had as to the make of the car, which his client was alleged to have in his posses- sion, was that it was A 520 two- Seater "Trot" motor car. He did not know what a "trot" was, whilst the engine number given might apply to any make of car. His client had in his possession a Fiat motor car, of the same engine number as that quoted, and a licence number of 2058. The bill of sale described it as a "Trot" motor
