Witness joined the company in 1920, when he invested $90,000 in the business. This had been left to him by his father. He satisfied at the time that he was going into a good business. From enquiries made he had learned that the firm, prior to that time, had; been doing very well, but from the time he joined things went badly. Just after he joined the yearly pro-" fits grew less and less until the time of the bankruptcy in 1925.

He attributed the cause of the failure to depressed trade, bad conditions, and a heavy loss on a tannery, whilst the Swatow branchi also showed a loss. The business' was one of commission merchants for imports and exports. The tannery project was a big loss and never prospered.

In 1924 they considered them- selves solvent, and it was not until 1925 that things went very much against them.

The firm was a very old one in the Colony and he anticipated that as a result the trade marks and good will of the firm would fetch a considerable sum. It had established fifty years very much liked by the Chinese. He naturally thought that the good- will would fetch a good gum, and influenced by that they put in for a sum of $25,000. As a matter of fact the goodwill was actually worthless and the trade marks fetched but very little

had been present in the Colony, and Throughout the bankruptcy he

had at all times given assistance when required by the liquidators, and had always answered any ques- tions.

The company had a branch in Swatow and London, but the Swatow branch was a big loss, and was closed in 1922-23. The liabili ties were those of the firm.

His Lordship observed that the final dividend had been paid and given that Mr. Humphreys had

therefore every assistance. He ordered the examination to be closed.
