ACCUSED MAN TURNS KING'S EVIDENCE.
OTHERS CONVICTED.
There appeared before Mr Whyte Smith," on remand, at the Kowloon Magistracy this morning, on charges of stealing piping and Are bars from the steam launch Stanley, five members of the crew, the chief engineer and four stokers. One was discharged and four convicted.
Detective Sergeant Humphreys withdrew the charge against the second defendant, who, he said, seemed to know more about the affair than anyone else.
His Worship consented to the action but intimated that he did not know if the prosecution would
secure a conviction.
The second defendant went into the witness-box and accused the Afth defendant of having instruct ed him and the other stokers to dismantle the piping and iron bars which were sold for $12.80 and the proceeds divided among the five men, the chief engineer receiving two shares.
After hearing the evidence, his Worship intimated that the device of taking one prisoner out of the dock and getting him to give, King's evidence was justifiable,. but he could not say that his evidence had much weight.
His Worship decided, however, that the other men all had guilty knowledge and convicted all four. He pointed out that the larceny had taken place on July 7 while it was not reported by the chief engineer until last Friday, the engineer not being able to give a satisfactory explanation as to why no report had been made earlier.
The engineer was fined $25, while the others were fined $10 each.

Following a petition from rela tives asking for the option of a fine, Afr. Whyte Smith at the Kow- loon Magistracy this morning re- considered the sentence of one month's hard labour which he im- posed for larceny of two tins of milk on Friday.
His Worship, addressing. Mr. T. Ferguson of the defendant's Go- downs, said that he had received a petition from the defendant's re- | latives asking for the option of a Ane. His Worship was, rather in- clined to agree as it was, after all, a pretty heavy penalty for stealing two tins of milk.
