COUNSEL SUPPORT MR. JUSTICE MCCARDIE.

ready lasted eight days, when such cases were supposed to last a few hours only.
He added that the only way In which the public could regain its belief in the efficiency and moderata expense of litigation was by counsel and solicitors co-operating to work the system to the best advantage and with a desire to save expense.
One of the most eminent men at the Bar summed up the views of This colleagues when he said:
"It la regrettable that Mr. & Justice McCardie should have had to speak in the manner he did, yet he was quite justified. According to the "Rules of the Supreme Court," when a writ containing a claim for a liquidated sum Is specially indorsed under Order III., Rule 6, an application can be made for summary judgment under Order XIV. There is an appearance be- fore a Master who, on the repré
or solicitor, sentation of counsel puts the case in the short cause list on the understanding that the issue is one which can be decided quickly. When such an action lasts more than a week other litigants are bound to suffer.

Annoyance."
"Where normally à case could be heard almost at a fixed time on a particular day, he said, the parties are compelled to wait till the long case is finished. This causes an- noyance and uncertainties and in- creases the expense. It is for counsel and solicitors to play the game in the Interests of the law and of litigants.”
Mr. Percy Hurst, secretary of the Law Reform Association, said: The only way to stop this spin- ning-out process and saving expense is to simplify the procedure and to establish a legal code such as they have in France and Germans."
There seemed to be no agreement with Judge Crawford, who stated at Barnet County Court that it was a scandal that the costs in an unde- fended di orce action should amount to £205.
Here is a summary of the views gathered:
Divorce Court Judges demand strict proof of all facts, and it is essential that money should be spent Jun inquiries. If the caer is one where adultery has been commitled at an hotel in Scotland, a person must go there to obtain the in- formation. A chambermaid is per- haps an essential witness, and she may have gone to another post in Wales. On arrival there it may be discovered that she has removed to Margate. A month may elapse in this way before the necessary evi- dence can be gathered.
