SERIOUS ACCIDENT

RECALLED.

MEMBER OF ROYAL AIR FORCE FINED.

NEGLIGENT DRIVING.

A sequel to a recent motor accident in which five servicemen were involved was the appearance of the driver of a Harley Davidson combination, before Mr Whyte Smith, at the Kowloon Magistracy, yesterday afternoon, on five sum- monses, to two of which the de- fendant returned pleas of guilty.

The driver, H. Tower, of the Royal Air Force, Kai Tack, was accused of having driven the com- bination while intoxicated, but,

hearing after

the medical evidence, this count was dismiss ed, while a further charge of fail- ing to have full control was with. drawn in favour of a count of negligent driving.

H. Tower was summoned on five counts under the traße Regulations, following an accident outside the Orient Tobacco Factory on the early morning of March 20.

Sergeant's Evidence.

Police Sergeant L. Boffin giving evidence said: At about 2 am, on March 20, I was riding in ricksha No. 87 along Nathan Road from South to North when. opposite to the Orient Tobacco Co., I heard this motor cycle coming from the rear. The engine was racing and apparently was travelling at a good diles. The next thing I knew was that the sidecar had hit the off

The defendant explained to the Magistrate that when the silencer was off the noise gave one the im- pression that the machine was go- ing faster than it actually was.

In reply to this Worship witness said that he was satisfied that the silencer was off.

His Worship: You Say the ricksha was knocked over? Was it knocked far?--No, as the off wheel was smashed and the ricksha just dropped down.

The ricksha coolie gave corrobora- tive evidence and intimated that immediately after the accident the five men left the scene.

Sergeant Boffin was recalled and asked by the Magistrate: Do you say that the defendant was driving the cycle? You have not said that. Witness: No, I didn't actually zee him driving, your Worship.
