II. The Harbour Master shall not be liable in Damages or otherwise for any when adopted by the done by him in pursuance of the Obligation and duty imposed on him by this Ordinan

Governor.

and in case His Excellency the Governor shall direct the Disposition of any Goods Article which shall have been seized by the said Harbour Master, such Direction sh be conclusive Evidence that the act done by the suid Harbour Master is within duty imposed on the said Harbour Master by this Ordinance,

PROCLAMATION,

By His Excellency WILLIAM THOMAS MERCER, Esquire, Acting Governor and Commander-in-Chief the Colony of Hongkong and its Dependencies, and Vice-Admiral of the same.

Whereas by an Ordinance No. 3 of 1862, intituled "An Ordinance to authorize His Excellency e Governor by Proclamation to prohibit the Exportation of Military Stores and other Articles," it senacted that it should be lawful for His Excellency the Governor by and with the Advice of the ecutive Council by Proclamation to be published in the Hongkong Government Gazette or in any straordinary Gazette to prohibit for such period as should be mentioned in such Proclamation either be exported from the Colony of Hongkong or to be carried Coastwise within the said Colony Armas, mmunition and Gunpowder, Military and Naval Stores, and any Articles which His Excellency might idge capable of being converted into or made useful in increasing the quantity of Military and Naval ores, Provisions or any sort of Victual which may be used as food by man or any or either of such ns, Ammunition, Gunpowder, Stores, Goods, or Articles respectively. And in case any such Arms, manunition, Gunpowder, Stores, Goods or Articles which shall have been so prohibited should be ported from the said Colony or should be carried Coastwise or be Waterborne to be so exported or ried they should be forfeited and should vest in Her Majesty and that forthwith thereupon it should the duty of the Harbour Master of this Colony by Warrant under his Hand upon his own view or con an information made upon Oath before any Justice of the Peace for the said Colony to cause all ch Goods and Articles so thereinbefore declared forfeited to be seized and to detain the same to the of Her Majesty and to be disposed of as His Excellency the Governor should by order under his. nd and Seal direct;

And whereas it has come to my knowledge that Arms, Military and Naval Stores and Articles able of being converted into Stores and comprised in the enumeration of Articles in the said rdinance have been exported from this Colony;

And whereas I being instructed to put an end to all such exportation from this Colony of Arms, ilitary and Naval Stores and Articles have determined with the Advice of the Executive Council of is Colony by this Proclamation to prohibit such exportation and carrying Coastwise in manner by e said Ordinance provided;

Now therefore I, WILLIAM THOMAS MERCER, Esquire, do by and with the Advice of the Executive buncil of this Colony hereby for a period of Twelve Months from the Twenty-eighth day of February, 363, and for such further period as shall from time to time be specified in any Proclamation to be after duly published, prohibit either to be exported from the Colony of Hongkong or to be carried astwise within the said Colony Arms, Ammunition and Gunpowder, Military and Naval Stores;

And I do with the Advice aforesaid hereby declare that all such proceedings for the suppression such several acts as are provided by the said Ordinance or by Law shall and may be taken for the ppression of such exportation and carrying Coastwise and for the forfeiture, seizure and detention I disposition of the same Articles and things and the punishment of Offenders against the said Laws.
