PROTEST BY THE POLICE LAWYER,
Following the dismissal on Wed nosday of last week of the criminal proceedings against Tau Zu-ching, the lawyer, on charges of intimi- dation and interference. with per sonal liberty, Mr. Van den Berg, Senior Consul's Deputy, revoked the suspension order concerning him by endoraing the charge sheet as follows: "The actions of at- torney Teu Zu-ching, which took place on February 23, 1929, out- sido the Court and which con sidered acts of contempt, having been made the subject of a crimi nal prosecution in this Court-im- plying an investigation into the facta which, if they were proved, would in my opinion justify, dis- barment-I hereby cancel my pro- visional suspension order of March 14-(signed) J. Van den Berg."
It will be remembered that this netion of the Deputy followed an incident in court when' in sitting on a case with Judge Kuh, the law, yer in question became obstreper- ous, so much so that the Deputy asked the Judge to take measures to quiet him.
The Judge, failing to act in the case, Mr. Van den Berg took mat- ters in his own hands and order ad the foreign police officers in the court-room to remove Tau Zu- ching by farce. The Judge pro- tested that such orders were to come from himself and not the Senior Consul's Deputy. This had an aftermath when the lawyer was alleged by the police to have intimidated certain principals in a case in which he was retained and ' to have acted otherwise unpro- fessionally in the Court com. pound. Eventually the police in- stituted proceedings and the case was hard and dismissed by Judge Hyuf, though not without a Berlous.argument with Mr. Ramon- dino, Senior Consul's Deputy, who ent jointly on the case,
The President's View. When seen Mr. Ho Shih-tsung, President of the Provisional Court, expressed himself as pleas- ed that the Senior Consul's De- puty had seen fit to cancel 'hle previous order.
"So far as the lawyer is con- cerned, that caso is disposed of," he said, "but I am of the opinion that the much bigger issue of who has the power to chastise a awyer, the Judge or the Deputy, remains to be settled. I have yet to discuss the matter with the judges of the Court but I believe I am unfe in saying that an order will be issued to Judge Kuh to sit with Mr. Van den Berg as before and hear such cases. 18 brought before him".

The refusal of Judge Kuh to hear cases when altting jointly on the bench with Mr. Van den Berg again came to the fore when the two and three criminal actions brought before them which Judge Kuh immediately adjourned."
In one a coolle was charged with the larceny of a roll of wire valued at $5 from the Shanghai and Hongkew Wharf Co. (British), while the second had to do with a breaking and entering charge, and the third was against several Chinese for disturbing the peace.
In opening the case for the nu-, thorities, the Police Advocate, Mr. R. T. Bryan, risked if the eases were to be adjourned, which was the fate of the previous cases brought before Judge Kuh and Mr. Van de Berg, and the Judge answered "Yes,"
