Major Taylor, in an affidavit, denied that the money was lent to him, and alleged that Mr. Brutton was really a partner with him. Ho proposed to counter-claim, but no such claim was entered nor did Major Taylor appear in court.
Mr. Brutton, who said he was 29, stated that after telephono con- versations with Major Taylor he sent him a post dated cheque for £60 to be used to negotiate a loan with a firm, of Weat-end money- lenders on the understanding that Major Taylor would take up the cheque with the moneylenders before it matured. Major Taylor signed a promissory note with the moneylenders for £60.
Moneylenders Pald.
As Taylor did not pay the moneylenders he (Brutton) paid them the £60. Taylor received £48 from them for the cheque,
Mr. Brutton, cross-examined, denied that with the Major and a Mr. Weeks they discussed about taking a flat at Brighton.
Judge Turner said he was satisfied that Mr. Brutton's story as set out in affidavit in the High Court and in evidence was absolutely true.
In none of the correspondence adid the Major suggest that thero was a partnership or that there was money due to him.
