It was alleged by the plaintif that the 1.0.U, was in respect of a loan for $93, whereas the do- fendant contended. that it was a gambling debt and could not be recovered. He asserted that the plaintiff's story was untrue and, through Mr. Leo. Tho plaintif declined to do so, however, saying he did not think it was necessary, and the case was proceeded with,
Mr. P. M. Hodgson was for the plaintiff while Mr. Leo D'Almada
defended.
Mr. Hodgson said, ho did not think it would be disputed that the 1.0.U. was given by the defendant, He (Mr. Hodgson) had received an extraordinary letter from Mr. D'Almada setting up the special defence of illegality. He under stood the defence was going to be that this money was given for a gambling purpose and was there- foro not recoverable.

On the station at Kowloon he met the defendant, whom he knew, who asked for a loan of 805, explaining that he was in count of $20, but they lost that urgent need of monoy. They both boarded the train but entered separate compartmenta. The plaintiff did not see the de- fendant again on that trip. Later the plaintiff asked for the money to be repaid, but the defendant made excuses.
Lost At Fon Tan, Mr. D'Almada explained the da- fonce was that the parties mot on. the ferry when the plaintiff told the defendant that he was going to Shum Chun to have a "fluttor." He asked the defondant to join' him. The defendant had about $20 in his pocket, and agreed to go. At Shum Chun they played fan tan with a joint account. They each put $10 to the joint account, mak- ing $20, but that was lost after three or four games.
His Lordship remarked that, It would be better to finish the case for the plaintiff before hearing the defence, and the plaintiff was call- ed to give evidence,
He gave evidence bearing out Mr. Hodgson's opening remarks and said that he had known the defendant for six months and his father for ton years.

Cross-examined by Mr. Almada plaintiff said that nome- times, on holidays, he went to Macao for a "flutter."

Replying to further questions. plaintiff said "I am not fond of Jan tan." He thought that the de- fendant was an honest man but: he was ungrateful. The defen- dant naked for only $95 and not $100. He had previously borrowed small sums such as $5 and $10, on occasions when he had spent all his money at Macao and had not his boat fare home. Those loans had been repaid.
Mr. D'Almada put it to the plain- tiff that the incident occurred: on August 18, last, that they met on the ferry, and that the plaintiff Invited the defendant to go to Shum Chun. This the plaintif denied.
He further denied that they wont to Shum Chun together to play fan tan, and that the capital at' thei start was $10 each.
That you found you had lost |$100 each and on the defendant only had $5 you asked him to sign this I.O.U. for $95 on the way back?-No.
Cutting of the Cock's Head.
Mr. D'Almada, addressing his Lordship, sald he was going to ask his Lordship's permission to pat a question as to whether the plain- tlf would be prepared to "cût off the cock's head." He had almilarly applied to Mr. Justice Gomperts (as he then was) and his applica- tion had been allowed. If the plaintiff was prepared to go to a Chinese temple in the usual Chin- ose fashion and "cut off the cock's head" then they were prepared to withdraw from the action. An adjournment could be granted for that purpose.

His Lordship gave judgment for the plaintiff with costs.
