SINCERE COMPANY WINS CASE.
(Continued from Page 7.)
The only point for me to con- sider is whether the plaintiffs' manager did, in fact agree to take back auch goods as the syndicate were unable to sull. I reserved my decision, on the point in order that I might consider the evidonca which had been put before me on the three occasions when I sat to hear this case.

Conflict of Evidence. There is a conflict of evidence on the point. The defendant con- Lends that there- was an agTCO- ment, the plaintiffs deny it. It is for
ATTEMPTED BRIBERY OF DETECTIVE.
SUSPICIOUS CHARACTER IN: YAUMATL
A fine of $50 or six weeks' hard. labour was imposed by Mr. W. Schofield at the Kowloon Magis- tracy this morning on a Chinese who was charged with offering a bribe of $3.70 to a detective. **-
Defendant denied giving the money voluntarily and said that he was requested to produce all the money ho possessed, and to hand it over to the constable who then ae- cused him of having stolen it.
According to the evidence of two Chinese detectives who were on patrol in Portland Street during the carly hours of yesterday morning, they met the defendant charging from Pitt Street and searched him. Lodged in the back of his coat they found an electric torch while a handkerchief was tied round his lag. It was then" that the defen- dant produced $3.70 which he gave to one of the detectives, later pro- ducing another $10 note, which he also handed to the police officer.
Defendant was placed under ar rest
The defendant denied the charge | but after hearing the evidenca his Worship registered a conviction. In addition to the fine his Worship ordered the $3.70 to be confiscated.

His Lordship's Pisbellet,
They certainly do not convoy to me the impression that unsold- goods were to be taken back, and I do not for one moment believe that" they, really conveyed that menning...... to the defendant's witnesses who were present at the interview-all of them'men with some business ak perience.
If the defendants really under- stood at the time that unsold goods were to be taken back, they were quite right in deciding that they ought to have some written ovid- ence of the fact and they could casily have obtained it by writing to the plaintiffs and stating what they believed the agreed torms wero and asiting the plaintiffs to con- firm.
Mr. Yushie had an opportunity when he wrote and gave his name. as a signatory for orders shortly after the arrangement was made, but he appears to have neglected it. Again, when a written order was; given later, for somo. Mah Jongr acts, he might easily have stated In the order that unsold sots "wora to be returned.

Bad Business.
The defendant's syndicate was disappointed with the result of their business with the Japanese Fleet and had more than half the goods, which they had purchased, left on their hands. They did not at once pack them up and return them to the plaintiffs as I should have expected them to do, if they had made the arrangement they claim, and they have not yet sent them back.
The plaintiff's cashier, whe visited them to obtain payment of the defendant to satisfy me that the account after the fleet loft, his contention is correct. Looking admitted that something was sald at the facts, the first point that by the Japanese gentlemen about the plaintiffs' business is that of a returning unsold goods, but he cash store, though I believe they had no authority to do anything give credil to customers who are about this and naturally referred known to them.
