In reply to Major Willson, the Inspector Alexander said police evidence would have been that there was no pedestrian at all crossing the road. If a pedestrian had been crossing the road that would cortainly have helped the defendant, as it would be consider- ed that the accident to a certain extent was unavoidable.

Major Willson called for Inspec- tor Alexander's opinion concerning the net of the defendant in over- taking the first car, and Inspector Alexander" replied that there, again, the police evidence would be that the first car was travelling at 15 miles an hour, and the de- fendant's car must have been pro- ceeding at a high speed to have overtaken it.
Mr. Lo reminded the Court that it was raining at the time,
Inspector Alexander said that had the defendant kept to his own side of the road, nothing would have happened.
Major Willson, in giving his declafon, said he regarded it was a very dangerous thing for one car to pass another in that parti- cular locality in Wanchal. His Worship considered it as no ex- cuse at all that it was raining. He imposed a fine of $50.
