TELEPHONE TAPPING LEGAL IN AMERICA.

Washington, Jung 5.

In a docision which. startled Washington, the Supreme Court yesterday, by a divided bench of 6 to 4, held that evidenco Illegally obtained by the Government 1s admissible in a criminal prosecu tlon arising under the Prohibition Law.

The case came to the Supreme Court on appeal from the State of Washington, where the defendants had been convicted on ovidence obtained by Prohibition agents, who, by tapping telephone wires and by overhearing conversation without, the consent of the Tele- phone Company and knowledge of the defendants.

secured in- criminating evidence.

On the ground that wire tapping was illegal, and inviolation of the Constitutional velo on "unreason- Lable search and seizure," and that the Governmont itself had been guilty of crime and could not com- mit one crime to secure a con- vietion on another, the defendants argued that the evidence thus illegally obtained could not be admitted.

Nevertheless, the Chief Justice and his four associates have held that while the Constitution pro- hibited a man being arrested or his papers seized without u search warrant, the Constitution sald nothing about the privacy of the Lelephone, the telephone being un- known when the Constitution was adopted.

The Prince of Wales has accep- ted membership of the H.A.Č., and was formally admitted June 25.
