The jury had held that the words complained of were not defamatory.
Lord Justice Scrutton said that personally he might have given a different verdict from that of the jury, but that was not the ques- tlon.
If the jury had, as they had a constitutional right to do, declined to answer questions and given a general verdict for the defendant, the Court could not possibly have interfered. The question of libel or no libel was pre-eminently a question for the jury. Whichevor- way they found, the Court would rarely interfere.
"I hesitate to say the Court will never interfere, but I cannot think the present case is one where they will," The appeal must, bo dia- missed.
Lord Justice Sankey concurred.
Judge Dissenta.
Mr. Justice Russell dissented. In his view the worda complained of ware necessarily defamatory, or they were used seriously, in their natural sense, and they accused the plaintiff of being unfaithful to his employer in one of the first duties of a chauffeur.
