Further questions were put to. Mr. O. B. Raven by Mr. Jenkin this morning before Mr. Eldon Potter addressed His Lordship.
Counsel said that the question of the extras divided itself into two parts as far as they were con- cerned. Were the works claimed for by the plaintiff really extras, and if so, which he submitted they were not, did the defendant order them within the meaning of the cases cited?

A "Dirty" Case.
So far as the plaintiff was.con- cerned it was a "dirty" case, if counsel might use the phrase. Every endeavour had been made to fight the case and yet the mo-. tive did not seem to be à too im- pelling one. It must not be for- gotten that the whole claim was for only $26,000 and in connexion with that sum the plaintiff was one of four partners and would only be liable for about $6,000 himself.

The plaintiff's story with regard to the estimates erested suspicion in one's mind. His story was that before any work was done the estimates were taken to the de- fendant who agreed to the price. He had stuck to that story--the story that the first time the estimates were taken down they were agreed and settled. That in itself was inherently impróbable, The whole foundation of the case was the estimates themselves. The story of the estimates had shown that the plaintiff was prepared to tell untruths to suport his claim for extras,

It would spear, from the report, that prior to the arrival of the rignile, a small fire was observed outside the premises by the police, who discovered that a disused gas pipe, from which gas was escaping, was the cause of the fire...
The police entered the ground floor of No. 96, when they found five of the inmates, of the house in an uneonacious condition, having been "gassed" as a result of the leakage near the premises.
Exactly how long these persons had been unconscious is not known, but three of them were in a con- dition which necessitated their re- moval to hospital.
