Introduced into this case are

several unusual features.

A partnership agreement in writ- ing between a Russian dealer in race ponies, and a member of the International Recreation Club, in which the profita (if any) accruing from racing certain ponies is to be divided.

:

The question of the classifica- tion into the cross-bred and China: pony classes and their subsequent branding is another point, and on this question, the plaintiff called export evidence yesterday.

A Hang Dog Expression.. The Judge then handed witness a photograph of a pony and ask ed witness to decide whether the pony was a cross-breed or a China pony.

Witness: I can't tell very well. from this photograph, because if a pony is not given his food, he will hang his head and that is what the pony in this photograph is doing. If the pony were hero I could tell, but I think the photo- graph shows that this pony is rather like China pony..

Mr. Fishman: As an expert can you definitely say whether an animal is a China pony or a cross- breed 7-Yes, I can.

Counsel: How can you distin- guish them?-By their build.

Counsel:The wish of every owner is to get his pony into "y" class? Yes, of course.

Counsel: If a pony beat all other "Y" class ponies what would he be worth? Between Tls. 10,- 000 and Tls. 20,000,

Counsel: If the same pony ran in "2" or cross-bred class, what would be his value?-About Tls. 1,000.

Counsel for the plaintiff stated that he was of opinion that it would take at least two whole days to complete the case and asked that the court sit for that period on this case alone. Then followed an argument between counsel in regard to witnesses being kept out

He understood that he was to get half of any profits ac- cruing through racing and that expenses had to be divided. the ponies were sold and realized more than $3,000. Re-examined, witness said that defendant had never given him any opportunity to exercise any con- trol, in regard to the training of the popies, although defendant had agreed to provide a room for plaintiff's trainer, which, in fact, had never been done. For this reason he did not know anything about the branding of the ponies. Witness had emphatically refused to give two prices on the ponies, one price before classification and another price after classification. The class into which the ponies were placed, did not concern wit- ness. Only in one case had the question of class been discussed,

Maybe you see a pony and know he is "Z class, but you can talk with somebody and fix it up and get him into "Y" class. Dealers cannot race ponies, the ponies are bought unbranded by members and run by them.

In further reply to counsel, wit- ness said that if a pony changes; hands it is regarded as second- hand-like second-hand goods if it were a good pony, the owner would not sell him. The. value of a pony which had won about Tis. 2,000 In a season by winning and placing In several races, would be worth about Tis. 3,000.

Cross-examined by counsel for the defence, witness agreed that expert opinion on ponies was like expert opinion on anything else- it might err.
