Légal Rule.
If the court came to the gun- elusion that the object was unlaw-" ful because the rules were such, it would then be an unlawful as sociation, and the Court could not grant any relief. He submit- ted that, granted the Association itself was lawful, there was no reason why the Court should hold it was unlawful because one of the rules was illegal,
He was assuming that the rulo in question was illegal, but if he was granted leave to appeal, he would argue, as at present advis od, that the rule was legal. If it was still held against him that the rule was illegal, he would con- tend that it was entirely separable "Stilke your pen through the from the remaining. ten rules. rule," added Mr. Potter, "and you will have left a perfectly good.and coherent agreement between the Guild and its members, and you will find that every other rule re mains intact,"
Mr. Potter also pointed out that there was no rule that the accumu- lated funds should be applied in respect of the rule in question. If the Court found the Guild's objects were legal, then it would take a great deal to say that the Guild was illegal because of that rule.
Dealing with the legality of the rule, Mr. Potter said it was most definitely laid down that there was nothing unlawful in inducing an- other man to refuse to work or strike. Did the rule, he asked, carry them any further than that? It was another matter, and "on- lawful if a man was compelled to refuse work or strike, or if he was penalised for so doing,
His Honour sald it was obvious- ly an arguable point, and leave to appeal would be granted.
