ACTION WHICH MAKES LEGAL HISTORY.
For the first time in the annals of criminal law, a limited company was indicted at Glamorgan Assizeg on a charge of manslaughter.
The case is one in which Cory Bros. Ltd., and three of their elec- trical engineers were charged with causing the death of a young collier, Brymor Edward John. There was an alternative charge of causing to be set a spring man- trap or other engine calculated t destroy human life.
John was killed by coming into contact with a charged fence at Messrs Cory's power station, Ot more Vale, during the coal strike.
The case is historical from the point of view, of law. Up to the there was no machinery provided passing of the Crimes Act of 1926
whereby an indictment against a corporation could be presented to a Grand Jury. The case was the first under the new Act.
When it came before Mr. Justice Finlay, Mr.Norman Birkett, K.C.. who led for the defence in the place of the late Sir Edward Mar- į Bhal Hali, ruse to challenge the in- dictment against the company, He submitted that the Act never intended that a corporation should be indicted for felony. Could it be contended that a corporation. was liable on an indictment for
murder? Thore was only one judgment for murder, and that was death, which could not be passed upon s.corporation.
Mr. Artemus Jones, K.C., for the
Crown, said the legislation had de- clared that manslaughter could be punishable by a fine, and, there- fore, the judgment of the Court against a corporation for man- slaughter could be executed by
