PRISON «DISCIPLINE.
SERIOUS CHARGES AGAINST
"INDIAN WARDER.
Before Mr. R. E: Lindsell, at the Central Magistracy this morning, Mr. J. W. Franks. (Superintendant of Victoria Gaol) instituted crimi- mal proceedings against an Indian ussistant warder for a breach of prison discipline and for offering a bribe to a European warder to have the fact concealed from the "knowledge of the, prison authori-
ties.
Mr. Franks. said he felt that the departmental powers, conferred on him were not sufficient to deal with an offence of the serious na- ture shown in the present' case.
In effect, such offences would lead to a serious laxity in prison discipline. The defendant was charged with giving five envelopes to à prisoner employed in the printing workshop to have an all- dress printed thereon, and later, when the fact was about to be re- ported, to have offered · Wardër Colline $6 as a bribe..
Mr. McCallum, who defended, in Commenting on the wording of the section material to the case, argued that the defendant's act, although contrary to disciplinary rules, could not have benefited the' convict, and therefore did not come within the spirit of the sec tlon,
!
When the offence was reported, the defendant very "properly came forward with a full admission, said Mr. McCallum, and a further point well worthy of consideration was that the address on the enve
lopes wits that of an Indian friend
in America. '.
Mr. Franks cross-examined de fendant on the "consideration". that would accrue to him from his fullment, at great personal risk, of his order, and defendant replied that he naturally expected that his order would be unhes talingly obeyed.
His Worship adjourned his de- cision on this charge for fuller .consideration of the point raised
by Mr. McCallum.
