THE HONGKONG TELEGRAPH,

WHEN A MAN MAY

KILL.

'RIGHT TO SHOOT PROBLEM.

"A man's right to shoot in de- | fence of his own to and property. was discussed at the Inquest re- cently on James. Albert, aged 24.1 of Balin-place, Bermondsey, who was killed in the affray at the lonely Ace Garage, Elthum.

The story of the shooting. which also resulted in serious in- Jury to Charles Follen, of Long; line, Bermondsey, was told by the proprietor of the garage, Mr. A. C. Broodle.

...

Albert and Follen are, alleged to have been concerned in an at- tompted theft at the garage.

Major. W. H. Whitehouse, the coroner, said that many important '| principles of English law were in volved in the case.

In Defence of Property.

There was the necessity on the Fone hand of allowing a citizen to rotain and defend his rights, and there was the necessity on the other hand of suppressing private warfare. If they had private warfare in this country things. would be unbearable.

In defence of man's liberty or personal property he might law Tully use an amount of force which was necessary. It must be proportionate, that which did not inflict on the injured mischiet out of proportion to the injury. In defence of life" and limb, how- ever, he might be justified in using such forces as might cause death.

Mr. Brodie the garage proprie- tor, of Dungan-gardens, "Eltham, then gave evidence.

Since he had been at the garage." he said, it had been broken into Three times before the tragedy.

On the first écension £100 worth of goods had been stolen, and, on the second ocension £20 worth." The third burglary, occurred, aix weeks ago, and the clam in respect of that was for 5120.

In consequence of these bur- glaries he obtained a firearms certificate and slept on the "pre- mises with his assistant.

The

Describing the shooting, said, "I was wakened up by hear- ing somebody trying to force the door I warned Taylor and then, slipping out of my hammock, went quietly downstairs. I heard the crash of breaking glass at the far end of the garage. I crept for- ward quietly and saw the figure of a man inside.

41rian farsand, and heard a voice say, 'Stand back." "I stood still, and something was thrown past may, hend. It was a piece of concrete.'

"I then took the pistol which I had put in my pocket, and told the man to stop, or I would re. There was a scramble.

"Warning Shot."

"I don't know exactly what was happening. Things were falling about, and there was a noise of a man moving hurriedly. After telling the man to stop I fired with the revolver, but not with the intention of hitting him, but eaus-, -ing-him-to-stop.

"After I fired I saw the man go out through the window.... All this time Taylor was in the garage. He switched on. the light on the store. We both went to the door and unbolted it, and ran out. F had my revolver in my pocket.

"I saw two men running, and went after them, and caught one. I put my arm around him, and he said, 'I am sorry, governor; I am done. There was blood on his side and shoulder.

"Then I saw Taylor and the other man struggling for the possession of the rifle They were both falling, when there was a report...

"Taylor got up and stood beside the man i went back to-the- garage and 'phoned for the police. After that I went to see how the -man-was."

The Coroner: I think you are a good shot?-I am with a rifle.

The Foreman:" Was the shot fired in the dark?--Yen.

Foreman: How many shots were fired?-One, to the best of my knowledge.

Coroner: You know that two cartridge cases were found?--I have no recollection whatever of having fired two.

The inquest was adjourned,
