New York, Aug. 16-Attorneys for Jack Kearns, former manager of Jack Dempsey, announced to-day that they had filed suit for a third of $1,000,000 against Dempsey, based on a contract between Kearns and Tex Rickard for bouts with Harry Wills and Gene Tunney.

The state license committee 'Lo- day denied Dempsey's application for a licence to fight Tunney until he has completed the athletic com- mission's order that he meets Wills first. This position was. takén de- spite the ruling of Attorney Gen- eral Ottinger that the license body was without power to refuse a li- cense after the champion was de- clared cligible by the athletic com- mission.

Kearns asserts that he contract- ed with Rickard for Dempsey, to fight Wills before July on or before October first. Dempsey was to re- ceive $600,000, for each fight and Dempsey was to pay Kearns one third of the million, whether the contract was fulfilled not, Kearns contends.
