The complainant in evidence said that he went to the dining room at about G.15 p.m. on August 10, whilst the Asin was still lying alongside the Kowloon wharf. He sat down for his supper at the same table as the defendant and thu boatswain,
During the course of the meal, the boatswain asked the witness to pass the butter. Witness sitting. on the left of the boatswain with the defendant sested between the two, held the butter dish in front of Outred and asked him to pass it to the boatswain. After holding it in front of the defendant for some seconds, without the latter shaw ing any signs of obliging the boulswain, witness reached across; the defendant's part of the table, and pushed the dish along.

After thus pushing the butter to the boatswain the latter asked he had intended throwing the dish to him. Witness, then said that' the defendant had refused to pass t, to which the defendant repiled that he did not see the thing and it was not a pig sty that they were In but a dining room.
