SUMMONS AGAINST MR. H. E GARDNER.
The misleading effect of giving Therely a part of a traffic regula tion on the back of a motorist's driving lience was stressed at the Kowloon Magistracy, resterday when Mr. H. E. Gardner, the well- known vocalist, was summoned for prasing another vehicle in a cons trolled arca
Mr. Gardner raised the defencë that the remarks on the back of his cence made no reference to pass- ing another vehicle and that he had therefore been misled.
Sergent Smith said he was riding his motor cycle in a controlled area. on the 27th of last month. There was a motor cycle and a bus In front; the bus leading. At the bend, Mr. Gardner who was driving a motor car passed witness on his right side and also passed the bus in front. Witness accelerated and joined Mr. Gardner near Public Square street.
To Inform, Not Mislend. The controlled area existed be- tween a spot on the other side of the Peking Hotel in the street be- fore the bus-stop and extended to
point near Market-street-They were marked by red' signs at Saigon street and Market streat.,
Mr. Gardner pleaded not guilty. and said his licence was issued this year on July 6. It said no- thing about passing another vehicle however. He thought it was the duty of the police to inform people and not mislead them.
Giving his reason for passing the police officer he said, there was a lady driving a motor cycle in front. She was apparently accompanied by, an expert, but was not very sure of herself. The engine of her machine threatened to stop at any moment, and in the interests of public safety he thought it his duty to pass her. He did not pass the bus

He added that the police should not issue misleading regulations
on licences, and Mr. Nihill pointed out that the licence bore a few Temarks and did not pretend to 12 give all the regulations.
No Penalty Inflicted.
Mr. Gardner said he had ques tioned other inotorists on the point and found that they all went by their licences. *****
Mr. Nihill said he certainly thought there was something in the point. It was very desirable that the whole of regulation 52 should be put on the licence.
The Magistrate asked Sub- Inspector Nicoll if section 52 of the traffic regulations on the licence was the section before it was amended. The officer replied that. The thought it was.
Mr. Nihill (to Mr. Gardner): There is no doubt that you are guilty of a technical breach of the regulations. In view of the de- fence you have raised, however I are not going to inflict any penalty. You are cautioned on the summons, and I will bring your point. to the notice, of the C. S. P.
