He submitted that His Honour could not admit the evidence to explain anything which was inconsistent with the contract as he considered it was. At Their Peril.

His Honour said, it appeared fo him the defendants' case was that they had done so much within the contract and so much outside it. Could they be heard in view of that?

Mr. Bennett submitted" they could not. If they lnd done any- thing outside the contract then they bad done it at their peril.

His Honour: The defendants way they had no duty to collect Freight as agents.

Counsel paid it Was the duty of an agent to collect freight and therefore defendants' pay- ment was $150. If it was some- thing an agent ordinarily did then he could not charge extra for it. If defendants' case was correcti

then they should have said in re- ply to the offer "Accept, entrance and clearance only."
