about $5 of the, money, claimed being owed for 'n table. Tho balance of $161 was for chocójátok- delivered to defendant. Thesa chocolates were supplied last. May and on a'sale or return basis, in : fact a letter from M. Durant sent with them at the time stated that they could be returned "within, a few days" if unsaleable! Defen- dant still held the goods but had not paid for them. Plaintiffs had sent for the money from time to time but had been unable to col lect it." Eventually a solicitor's letter was sent denunding pay ment and defendant's reply was by registered letter in which he stated that the goods were not saleable and that he wanted t> return them. This was the first intimation, said Mr. McCallum, the plaintiff had that the goods were unsaleable and ho wanted to re- turn them. Mr. McCallum went on to say that ho considered that if not wanted the goods should. have been returned within a rea sonable time. In this climate chocolates deteriorated very rapidly and he contended that from May until August was not a reasonable time but absolutely un- reasonable. The fact that defen- dant did not notify plaintiff earlier that the goods could not be soll could only be taken as an ac- ceptance of the goods.
After the delivery of the choco lates defendant informed the plaintifs that he intended to take out the chocolates from thele cartons zell them separately and replace them with Inferior ones. Defendant had not been long In the Colony and plaintiff had help ed him in the establishing of his business and in every way tried to be a friend to him. It was for this reason that the goods wera delivered to him on à sale or re- turn basis.
Defendant's Story,
Hi Honour stated that he thought it was up to the defendant to begin. Defendant in the wit ness box stated that he still held the chocolates. They were deli- vered to him early in June. He had them all except two boxes. He sold four altogether but two of these were returned. He told plaintiff early that he was not satisfied with them. A coolle came for the money for them and witness wrote on the back of the chit stating they were unsatis- factory and asking plaintiff come and take them away.
His Honour: Why didn't you send them back?-Having told him come and fetch them 1 naturally thought he would.

Cross-examined by Mr. McCallum witness said. of receipt of the goods he took them out of their case and displayed them in the window. It was his intention to sell them by the box, but he would have sold them by weight if cus tomers, had wanted them" so... He admitted that certain boxes had been opened.
When did you frat tell plaintif that you were not satisfied and wanted to return them?-On Jura 30.
But Mons. Durant was not than in Hongkong. He was away from June 20 to July 16,
Witness replied that he was in his restaurant many times in June and he told him then,..
Asked what facilities he had for storing such things as chocolatea in his shop defendant gald he had two ice chests. He kept the cho- colates in the window for three weeks and later put them in an. ice chest and eventually packed them again.
What condition did you expect. the chocolates to be in after three weeks exposure in the window? If they were good they should have, kept all right for at least six months.
Mr. McCallum submitted that opening the boxes was only con sistent with admitted acceptance and 'ownership of the goods. Moreover if unsatisfactory "they should have been returned dar
