In our application for exemption from the operation of Ordinance No. 8 of 1871 in unar. shared "espect of the S. S. "Cyphrenes" and which has been granted, we have inadvertently omitted to state, that according to agreement, the Steamer has to call at Macao Roads for a quantity of Cargo only, space for which has been reserved.

As the "Cyphrenes" is now under the Chinese Passenger Act, we shall be obliged by your informing us, whether you will grant this permission and make the necessary endorsement on the certificate.

The detention will not be more than a few hours.

In reply to your application of yesterday's date, I am instructed to inform you that His Excellency The Governor regrets that it is quite impossible to accede to your request.

Had His Excellency been aware of any such agreement as that indicated in your letter, he would have refused to exempt the " Cyphrenes" from the operation of Ordinance No. 4 of 1870, and if it is still your intention to carry out that agreement, the Certificate must be withdrawu and cancelled.

In reply to your communication of yesterday, we have the honor of enclosing the opinion of counsel, which we have taken in the matter of the Str. " Cyphrenes."

You will perceive that the Ordinance referred to in that opinion empowers the Governor only when"in Council" to revoke the License already granted, we should be much obliged to you therefore to inform us, whether your letter of yesterday coutains a final order of His Excellency *in Council" or not.

As the Str. "Cyphrenes" is ready to proceed to Sea at once having embarked all her passen- gers and stores, every hour's delay is of great consequence, we trust, we shall be pardoned, if we ask that this application may receive your very early attention.
