Reports grounds for holding that Vessels leaving Hong Kong for Saigon

to the provisions of

(Minutes)

are not subject

Notwithstanding the Governor's despatch

the minute on no 1626, we adhere to our judgment that in point of law, voyages between Hong Kong & Saigon

come within the scope & sections 3 and 5 of the Ordinance No. 8 of 1871, and that Vessels

that voyage

are subject to the regulations in Schedule B.

"Whether this was intended or is desirable is

not a question for us to decide in

this case. As the Ordinance is

drawn Saigon it appears to be in the same position

as all the other places named in schedule A. If it does not it is impossible to understand why it was mentioned in the Ordinance at all. The

words in sections 3 & 5 appear to be quite decisive on the point. At all events the Governor's interpretation of the law is

so open to doubt that we would submit it should not be accepted without the
