Briarly accepted the opportunity of considering the matter and upon the next occasion I was informed that he had complied with the rule. I therefore told him that under such circumstances I was able to take a lenient view of his case and inflicted a penalty of $5.
I also said, for the benefit of himself and his comrades, a number of whom were present, that if Briarly had not taken advantage of the opportunity I had given him and complied with the rule, I should have imposed the heaviest penalty, viz: $200 or in default six months' imprisonment.
I assured all present that they might rest satisfied that full consideration would be given by the Executive to any temperate representation they might make through their Department against the rule.
