Salary of the Office of Assistant Superintendent of the Five Brigade was made by my Predecessor, in accordance with the usual practice in this Colony, and is treated as an allowance for work done. The small Salary attaching to this appointment is rather an allowance for work done, and in justice can only be drawn by the Officer actually carrying out the duties of the post. There will be no excess payment in this head.

I have received Your despatch No 1 of the 3rd of January explaining why Mr. Tonnschy granted the full pay of the appointment of Assistant Superintendent of the Five Brigade, while acting for Mr. Russell.
As you state that allowances on this head have always been treated as allowances rather than salaries, I have no objection to an acting Officer being allowed to draw the whole emoluments attached to the appointment.
