We have not yet received W Paunceforte's report upon this attendance, and perhaps, Lord Kimberley will wish to wait for that report before deciding to allow, or disallow, this important change in the criminal procedure. At present I retain the opinion that a very fair way of arriving at the truth is a careful & just system, and that investigation by a Magistrate, it should be conducted & confined to the charge - Prejudicial system of inquiry into all the antecedents of the
accused of irrelevant matters - would be very
objectionable, and fear would be as much in the interest of an innocent person charged with an offence, as of the
prosecution.
