The Defendant under Ordinance No 2 of 1855 cannot even appear to the Action however good a defence he may have on the merits unless he enters into a Bond with sufficient sureties to satisfy the amount claimed in the Action in the event of Judgment being given against him. This is a great hardship, for a person though solvent may find it difficult to procure Sureties, and if he cannot do so, he is precluded from defending the Suit and his name is Gazetted and his Property is publicly attached to the great detriment of his commercial position and credit.
