This section should be amended by striking out the portion of it which makes trial by Jury not a matter of right but a question for the discretion of the Judge.
83 of the Shanghai Rules should be adopted or that the Recommendations on this subject of the Judicature Commission (which will be found at page 13 of their First Report) should be carried out.
