Defendant's Helpful Attitude.

TELEGRAPH: WEDNESDAY, DECEMBER 14, 1991:

David Tay, alias Tony Tano. who is being held by the police in (conséquence of advices from Singapore to the effect that he is connected with the theft of al sum of $10,000 from a European firm, appeared before Mr. J. R. Wood this morning on remand in the application that has been filed for his extradition.

Mr. G. R. Haywood informed the Magistrate that as the pri soner's solicitor, he had advised his client that no defence could be raised here because in any case he would be sent back to Sing apars to stand his trial. With regard to the sum of $4,000 de- posited by the prisoner in the United Motorboat Company for the possession of which ha under- stood the Crown would make an application to the Court, he would like to state that $300 of this belonged to the prisoner's wife, who was now left without any means of subsistence through the tying up of this sum. Con- clusive evidence would be brought forward to prove that this sum be longed to her, and he would ask his worship to give due allowance for this claim in any order he might make for the return of the $4,000 to the Crown.

Mr. Hazelriga, who represented the Crown, said that it was true he would make such an applica tion, but not for the present.

Mr. Wood agreed that he would | not make any order regarding the disposal of the money without hearing Mr. Haywood.

The prisoner informed the Cour: that he would prefer to go back to Singapore as soon possible.

The Magistrate, to Mr. Hazelting: Is it not possible to send him back by mutual consant in advance of the requisition papers?

Mr. Hazelrigg: I think so. It has been done in other cases.) Defendant can be sent back if he likes.

Can lbst be arranged?--Yes.

His Worship observed that a lot of trouble would be saved by that means. He proposed to adjourn the case for a week, and in the meantime if an application; were made to him for the release of the prisoner with the view of his deportation to Singapore be

would grant it.
