in the between decks, is to be kept clear for exercise, Exclusive of the space allotted to deck passengers. If the number of passengers the Arrow could carry in the between decks under the old scale was 370 - the number she might carry under the new scale would be 493.

What number she could legally carry as deck passengers we have no means of judging but we may feel certain that it would fall far short of the difference between 493 and 2000.

4th respect to the legal proceedings adopted by the Governor it appears to us doubtful whether the seizure of the ship was a proper course of proceeding in this case. The 8th section of the Chinese Passengers Act, which authorizes the seizure of a ship, attaches that penalty to two offences only - the sailing without or with forged or fraudulently altered Emigration papers. It is perhaps unnecessary in the present instance to pursue the question - but the proper course as we think in any future similar case would be to put in such the Bond given by the Master and his sureties under the 4th section of the Act.
