Act 18. and 17. Vic cap 104. Under this act the number of passengers a Vessel could legally carry was 370. As this appeared to be a flagrant breach of the law, the Governor when she returned to Hongkong directed that legal proceedings should be taken against the master. The ship was accordingly seized at the suggestion of the Crown Solicitor, but eventually the Governor consented to discontinue the proceedings against the master on the payment by him of a fine of £100. He was induced to consent to this compromise (1) because in the interval Her Majesty's confirmation of the Ordinance No 8 of 1871, which removes voyages between Prince and the Straits Settlements from the operation of the Chinese Passengers Act, had been received in the Colony; and (2) because the ship had been despatched from Swatow under consular superintendence.
3. The Ordinance No: 8 of 1871 reduces, in short voyages within certain specified limits, the area to be allotted to emigrants on the between decks from 12 superficial feet to 9; and allows deck passengers to be carried on a scale of one adult for every 16 superficial feet. And space on the upper deck, equal to 4 feet for each statute Adult.
