THE REPRESENTATION QUESTION.

On Saturday, the Kowloon Cricket Club, Bowls Section, will play the Kowloon "Bowling Green Club, in the Bowls League on the former's ground. This -leaves K.CC. only one more match to play in this League, that being with the Police Recreation Club, which will be played next week, also on K.C.C. ground.

P.W.D. BRIBERY CASE.

MAGISTRATE'S DECISION

OVER-RULED. '

In the Supreme Court, this morning, before a Full Court, Sir William Ress Davies, K.C., Chief Justice, and Mr. Justice Mel- bourne sitting, an appeal by the Crown was heard against the decision of the Magistrate, Mr. N. L. Smith, in the case of the charge of accepting a bribe by the No. 1 coolie of the P.W.D.

It will be remembered that the No. 1 coolie was charged with accepting a bribe of 85 with "à view to influencing his conduct as a Government servant in' son- nection with a permit, and the Magistrate eventually discharged the accused.

The Attorney General, the Hon. Mr. H. E. Pollock, K. C., appear- |ing on behalf of the Crown, argu- ed that the learned Magistrate had misinterpreted the Ordinance, in dealing with the case under Section 3 of the Bribery Ordin- ance of 1898. Counsel dealt at some length with the evidence taken in the Police Court in sup port of his argument that the accused had accepted a bribe which was offered with a view to influencing his conduct.

L

Their Lordships found that the learned. Magistrate had misinter- preted the section of the Ordin- ance and that the case must be remitted to the Magistrate for him to deal with on the evidence.
