DEPORTED FROM CANADA.
BRITISH EX-CIVIL
SERVANTS ACTION.
The treatment of British. im- migrants to Canada was the subject of a case in the King's Bench Divison recently before the Lord Chief Justice and e special fury, when Mr. Leonard Carrington, a retired civil servant, brought an action for damages.
the Oceanic Steam Navigation Company, Ltd., älleg- ing imprisonment and breach of contract
The defendants denied the various allegations, and said that if the acts
cts were as alleged they were done under the immigration Laws df Canada.........
Mr. Schwabe, K.C. said the case involved the liberty of the subject, and in particular the position of an Englishman on board an English ship in Canada.
Mr. Carrington, a son of one of the registrars of the High Court: and a tan educated at Cambridge. had previously suffered from and bean eured of tuberculosis and had retired from the office of the Master of Lunacy with a pension in 1904. Since that time he had lived a roving life and travelled a good deal.

PUT IN A CAGE.
In October 1912 he booked a second-class passage to Montreal by the Laurentic and arrived at Quebec on November 2. He was told to go to the cabin of the ship's surgeon, and was there examined by Dr. Bailey, the United States immigration officer, and Dr. Ro- bertson, the ship's surgeon."
Dr. Bailey said that the plaintiff had got tuberculosis. He denied shat, and told the doctor the facts of his case. He was told to go to his cabin, where after about an hour he was visited by a man in the uniform of a chief steward, who arrested him and said: "You have to come ashore with me. Plaintiff submitted to the chief steward's authority, and on share was taken to a place on the quay and put into what was descrired .39 a cage.
*
Ultimately he was brought before a board and cross-examio. ed about tuberculosis. He was, then returned to the cage, and in the afternoon was taken in charge of some official and placed with athars in a wagonette and driven to: a detention hospital in the outskirts of Quebec.
Mr. Rigby Swift, K.C., for the defendants, intimated that he would object to the tendering of Any evidence of anything that happened after the plaintiff left the ship.
"PRISONERS FIRST."
Mr. Schwabe said the plaintiff was told that tuberculosis was suspected, but that there was no proof of it, and that he had been ejected on the ground of physical defectiveness. Not wishing to waste time appealing to Washing ton, and thinking that everything was in order, he was told, în reply to inquiries, that the only alter native was deportation from Canada.
He got a passage on the Laką. Champlain and was taken to the quay, still in custody, with others, to go on board tha: steamer. When they got alongside, the official in charge called out "Prisoners first," and the plain-. tiff was allowed the privilege of going up the gangway in front of the others.
Giving evidence, Mr. Carring. tou described his experience, and alluded to being put into a cage.
His Lordship: What sort of cage? A large room with wooden bara separating the different classes.
In cross-examination plaintiff said be had retired on a pension through ill-health at the age of 33. He had not tried to do any work since.
"DOCTORS' ADMISSION.
.. Dr. H. W. G. Mackenzie, con- ultant physician to St. Thomas's Hospital end the Brompton Hos- pital for Consumption, said that in 1912 plaintiff came to him to be examined after his Canadian experiences. Plaintiff's was a case of arrested tuberculosis. He was not in an infectious state, was perfectly fit to go among his fellow men and live a.s ADI ordinary persÖN.
Mr. Rigby Swift: Sound as be may be, his appearance is enough to excite the curiosity of an immigration officers Quite. His appearance is very much against- him-
Mr. Swift, opening the defence, said, the plaintiff could not have suffered one farthing of damages.
