The Vessel arrived in Harbour on the 11th inst., and as I had some doubt that the Captain would not apply for the man, I had him sent on board the "Harpedon" in charge of the first Boarding officer of this department, but this officer had scarcely left the Vessel when the cook was ordered over the side by the chief officer, who stated he did so by the Master's orders. Immediately issued a Summons requiring the Master's attendance.

at this office to explain his extraordinary conduct, which Summons was duly served on the Captain on board the Vessel; his reply to the Constable was "that he would not attend" and the Vessel, having steamed up, the Anchor was lifted and left the Port before a Warrant could be executed.

There is no excuse whatever for the conduct of the Captain as he came here with Mr MacKintosh of Messrs. Butterfield & Swire who are Agents for the Vessel, to protest against taking the man. I told him he would have to take him. The Captain and Mr MacKintosh became very excited, and the Captain said he would not take the man.
