Sir A. Kennedy's despatch is not very decided, but his conclusion appears to be that although he would plead to exempt the Messageries Maritimes Steamers from the operation of the Passengers Act, he fears it would be almost impossible to restrict the exemption so as to prevent its being taken advantage of by vessels to which it was not intended to apply. Under these circumstances, he proposes that this Council leave the matter at present as it stands. And he expresses his opinion that the Messageries Maritimes will acquiesce in this as their steamers are exempted by the Colonial Ordinance No. 8 of 1871 from the operation of the Imperial Act of 1855. As, however, the Ordinance of 1871 prescribes conditions as to survey, isolation, etc.
