I enclose a copy of the papers including the Warrant authorizing the deportation of the Arwone to this Colony, which I found apparently under the authority of Section 109 of the Order in Council, 1866, and I beg to point out that the only course open to me is to direct the Prisoner's discharge from custody under the 115th Section of the Order.

This is the second occasion that this particular Prisoner has been deported here, as will be seen by the enclosed letter from Her Majesty's Consul at Kanagawa, Enclosure No.1, and as he is a native of another of Her Majesty's Colonial Possessions, not far distant, it is peculiarly unfortunate that no means exist to forward him to his home.

I think it right to bring this case to Your Lordship's notice, as it appears to be a peculiar hardship to this Colony that such Criminals should be let loose among us. And I would venture to suggest an alteration in the Order in Council by which both the Chief Judge and the Governor of this Colony should have power to deport British Subjects to which Colony or Possession of Her Majesty's they may deem fit.
