chief. engineer of the steamer Loveclare, engaged in Admiralty work. He was badly jojured on Ja uary 4, 1917, through the vessel being sunk by a mine or torpedoed, and died the same day in underland Infirmary. At the time of his death he was receiv- ing £5 58 per week, and his sister, wh kept house for him, regular- ly received his half-pay note. The point at issue was whether the man was a workman within the meaning of the Act: Section 13 of the Act said that the term "work- man" did not include may person employed otherwise than by man- ual labour, whose remuneration" exceeded £250 per year. At the time he was killed Kennedy was receiving a higher rate than that, but added Mr. Maynell, the s-ction said nothing about a rate. Until he was engaged in Novem- ber, 1916, to take the place `oa the steamer of the chief engineer, who had taken ill, Kennedy was second engineer, and the appointment on the Inveclare was only temporary, and would have been relinquished when the chief recovered. the appointment was only temporary the Admiralty had no case. His contention was that it was not temporary, and, that there was a fair inference that the employment would have been continued. That being so, the defendant was not a workman within the meaning of the section. John Frederick Wilson, superintendent engineer, of toe Admiralty Coasting Trade Do- partment, said when he engaged Kennedy he did not give the man to understand that the employ- ment was only temporary, Had the former chief engineer come back he would probably hava been given the ship agaio, but Kennedy wou'd have been given another vessel.
