Germany, which guarantee was Sir J. Simen, K.C. ad Mr. R. A. Wright were for the plaintiffs, Nielson for the defendants. Sit and Mr. Greer, K., and Mr.
J. Simon, in opening the case, said that the object of the plaint- iffe was to have a declaration that the charter of the vessel was altogether at an end owing to the outbreak of war, whilst defend- ants contention was that that the contract, though not continu-. ing to be effective during the war. wuld revive at the conclusion of hstilities, and that the charter would then go on for the remain- ing three and a half years of its upcompleted term. It appeared that by the charter-party, dated January 18, 1913, between the Regist-res British Vulcan Co., of Holland. as Co, it was agreed that the latter concern should hire the Feragarth for about five years from her delivery to run in certain specified trades, payment to be made monthly in advance. There was a written guarantee, dated February 27, 1913, for the Dutch company's due performance of this contract, the guarantee being given by the Ka ser Company, of Hamborn, in Germany, An August 4, on the outbreak of war with Germany, the Ferng arth was at Rotterdam under the charter, and on August 5, the charterers gave notice suspending the charter-party during the continnincs of hostil- ities under clause 27 of the agreement, which dealt with the point as to an outbreak of war between the nations under whose Bng the steamer belonged, and some, other, ropean Power. Some time after this it became known to the plaintiffs that the charterers' company though said to be a Dutch company, was in fact the property of and under the control of the Kaiser Ccm- pany, a large engineering and shipowning concern in Germany, the charterers only being this. company's nominees." It was the contention of the plaintiffs that the chaiter-party on the outbreak of war with germany. became
