There shall be an opening left in the said Pier for the passage of boats at a distance of not less than 350 feet from the commencement of the Pier at the wall of the Praia, such opening not to be less than 40 feet wide and so constructed that between high water marks and the under floor of the Pier there shall be a clear span of not less than 10 feet; and accordingly the plan of the said Pier shall be amended by providing for such opening and
