that these various German agen- cies were not terminated till January, 1915. A letter was

Even allowing that Britian subjects at that early state of the war had not fully realized the magnitude of the struggle, nor the character or their opponents, I cannot say that it is a letter that should have been written by British company to Germang then a war with the British Empire.
Bat the letter July 1st, 1915, is one which calls for much more explanation, and I noticed that no mention of this letter was made by counsel for the defendant Company in his fast speech. This letter terminated the sgascy of Telge & Sch cater and contain- ed words which the Secretary of the company admitted "rather showed the agency may be resumed on the termination of the war," and he added that similar letters had been sent to the other German agent. Be it noted that these letters were writ- ven months after the war started and when the mature of the warfare had been fully disclosed. It is common knowledge that after the war the present bitter commercial struggle will be in- tensified. Yet here we find s British company proposing to employs agents, firms of

mercial ziral in Uhins of their own nation. If other British firms. or companies adopt similartactics, can the future prospects of our trade be viewed with equanimity? I leave the answer to British commercial men in China.
I now turn to the case which is before me for decision, and I propose first to find the facts, and when those are ascertained, to deal with the law to be applied to them.
The facts I find are that Telge and Schroeter, the Bankow agents of the defendant Company, issuDİ. |the policy -- that the bills of" lading were in the name of Carlowitz and Co., of Hankow that the consignes was Townsend Bushmore of New York, a perź- ner in the firm of Oszlowitz ad Co. at any rate în 1913; that the firm of Carlowitz and Co., has ita head office here, and is registænd in the German Consulate hote that the cargo left Han in the air. Kutwo and Shan in the at Indrs, both Britis steamers; that it was Blupp subject to waɛ risk; and that the property of Carlowitz:
