The Hon. Mr. Landale agreed with the Hon. Mr. Hewett and said that Probate Duty in this Colony was an unfair tax and he would go further and say that Probate Duty was an unauitable tax. He thought that the State was not entitled to charge the estate of a deceased person any more than a sam which would be suflicient to defray the cost of the machinery to ensure that the money passed to the rightful owner, which roughly speaking, was about 3 per cent. Any larger charge waa treating capital as income and in his opinion it was not the correct thing to do.
