Mr. W. E. L. Shenton, of Mesars. Doacon, Looker, Deacon and Haraton, appeared for the prosecution, and Mr. Davidson, of Messrs. Hastings and Hastings, appeared for the defence.
The photographer said he took the photograph and his name was on the reproduction. He took it at Kowloon Station. The photo- grapha produced were exact copies of his.
Mr. Davidson argued that there was no fraud, and there was no evidence to show fraad. The defendant was the manager of the Sun Company and he did not know, as a matter of fact, that the photographs were copied. He could not be responsible for the actions of the agents.
Mr. Shenton argued that the Copyright Act applied.
The hearing was adjourned. until to-morrow afternoon.
