Plantation Rubber is etesty, al though quiet, Standard, No. 1 Crepe being quoted 18: 11 3/4 per Ib and Sucked Sheet 24, 2.3/44. per lb. Fize Hurd Para is 28. 10...4d. per lb Straita Tin is £146 10. to £147 for cash, and £142 to £142 10. for three mouths.
The Mitsui Timber Dispute. Judgmert was given in the 'King's Bench Division, London; on December 21 in the case of Mitsui and Co. v. Mumford. The élaim in this case wra for £13,000. In giving judgment, Mr. Justice Bailhacho said that the policy covered a three months' risk of loss of timber at Antwerp caused by war, but not confiication by the Government of the country in which the property was situated. The plaintiff claimed in respect of a loss or a total constructive loss and pleaded that they had given notion of abandonment, treating the policy, as if it were a marine policy. This wee boei- ness policy, and if the facts showed a loss of the timber in commercial sense be should.hold that the plaintiffs were entitled to succeed. The fact was that} the timber remained stored in the same war, houses as at the date of the policy, and had been watched by two agents of the plaintiffs] in whose custody and under whose control it was until the end ef November. The plaintiffs spid that though the timber bad not yet been seized by the Ger mone there was strong probability that i would be confiscated or commandeered by them, and that if it was commandeered it would be represented by receipts of more than doubtful value. Bo felt, however, that he ought not judicially to assume that the Germans would commit a breach of international law and refuse to pay for the timber if they took it. Without seizure the plaintiffa could not lay any foundation for their claim. Plaintiffs took up the attitude that if the commercial venture was frustrated the under- writers were liable, and that the events that had happened involt- ed an indefinite postponement of the sale that was equivalent to a loes. At present the goods were st Antwerp. There had been no seizure, and the claim for a loan therefore could not be sustained. He gave judgment for the defendant, with coste.
Swiss Hotel Industry, The Swiss hotal industry, which has been hit exceptionally hard by the war, has lately been engaged in a lively discussion as to the advisability of opening winter sport hotels in the Alpine resorts.
