Again a point that whatever objections are to be taken to the execution of a Warrant ought to be taken before the Court which issues the Warrants and that as Marshall have no discretion whatever in the matter but must carry out the strict injunction of the Warrant which says "WE do hereby empower and strictly charge you jointly and severally command that you omit not by any reason or liberty or franchise but that you arrest or cause to be arrested the Steamship ... and the same so arrested you keep under safe and secure arrest until good and sufficient bail shall have been given according to law" for ...
It was impossible for me to arrest a vessel just on the point of starting without taking decisive steps. Till I saw that they were resolved to go whether I was on board or not that I called in the aid of the Water Police - who I contend take the place of the Coroner's Officers here and as such were bound to take charge of the vessel for me as their superior.
