6. The ouse for plaintiffs was that about 5.45 on the afternoon of March 8, the Alexandra was pro- ceeding up the Huangpu river on bor starboard side of the obanuel, a little below the launch jetty at Woosung Forts Station, and a good look out was being kept. The Poltava was at that time pro- ceeding down the river, about mid-channel, and approximately 1,000ft. distant. The Alexandra ecunded оде whistle and ported her helm, and the Foltava replied with two whistles and appeared to starboard her helm. The Alexandra then blow three whistles and went full speed aatern, and the Poltava replied with three whistles, but came on at a considerable speed. and with her stem struck the part bow of the Alexandra, doing her considerable damage. Plain- tiffa alleged that the collision was due to the negligent navigation

of the Poltava, which" did not keep a good look out, failed to. keep on her starboard side of the channel, failed to pass the Alexandra port to port, proceeded at a rate of speed excessive in the circumstances, and did slacken speed or stop or reverse her engines. In their anawer to the petition the defendants said that when the Alexandra was sighted the Captain of the Poltava gave the order to keep to star- board. The order was complied with, but as the steamer continu- ed to drift to the left, command was given to "keep her hard a starboard." Still the bow of the steamer continued to go to the left, the vessel failing to answer her helm in. consequence

a sudden break in the steering gear. The order "fall speed was then given, and at the same time the Poltava blow three short blasts. The Alex. andra continued to come onward

she went to starboard, the Poltava adopted the last means of avoiding a collision, viz., im- mediately dropped her anchor, the engines going full speed astern. As the Alexandra came further ahead at the same speed, the Poltava again blow thros blaste. The Alexandra answered.. also with three blasts, and was set full speed astern; but it was then too late. The momentum of her speed caused her to or ash with her porlaide against the bawa of the Poltava. For some reason or other it appeared that the first signal of three blaats from the Poltava was not en-understood by those on board the Alexandra, and in defend- ants' opinion this ultimate- ly led to the collision. Even had the signal been incorrectly receiv- ed, defendsats contend that the Alexandra should not have con- tinued on her course at the same speed, but should have taken a course to her left, which she could easily have done owing to her. lightness and shallow draught, in which case a collision would have been avoided. The Poltava kept amoat careful watch and was. properly piloted. While passing a junk she was compelled to steer Bomewhat to the left side of the channel, and at this moment there
