Your Lordship will not fail to observe the following facts.
The Registrar of the Vice Admiralty Court issued his Warrant for the seizure of the Messageries Maritimes Steamer "Ava" without having consulted the Judge of that Court, informing himself whether he had legal authority or jurisdiction. M. Dompnachy, the Marshal, proceeded to execute the Warrant,

accompanied by armed Police, furnished to him by the Captain Superintendent of the Police. The latter Officer, having previously concerted with the Marshal, aided and supported him with a reinforcement of Police - both Officers having avowed their intention of using force if resisted:

One, or both of these Officers made application to Commodore Shortt, in command of Her Majesty's Naval Forces, for assistance in their proceedings, all this being done without any sanction or reference to the Executive, save that conveyed in the illegal Warrant of the Registrar.
